Joe Mando is a partner with the law firm of Faulkner, Hoffman & Phillips, LLC, who has been practicing labor law in Ohio since 2007. Joe joined Faulkner, Hoffman & Phillips in 2008, and he was promoted to partner in 2014. Joe works tirelessly on behalf of the firm’s clients to ensure the best result possible. Clients and opposing counsel appreciate and respect Joe’s pragmatic nature, knowledge of the applicable laws, and his ability to efficiently find solutions to complex legal problems.
Joe has substantial first chair experience and he has successfully represented clients in cases before the U.S. Court of Appeals for the Sixth Circuit, the U.S. Federal District Courts for the Northern and Southern Districts of Ohio, the U.S. Bankruptcy Court for the Northern District of Ohio, the Ohio Sixth and Eighth District Courts of Appeals, as well as in several Ohio Courts of Common Pleas. Joe’s representation in federal and state courts have resulted in the recovery of millions of dollars in delinquent fringe benefit contributions, the dismissal of cases claiming that a union has breached its duty of fair representation, the dismissal of various tort and civil rights actions against unions, the issuance of sanctions against opposing counsel, orders compelling arbitration, and orders enforcing arbitration awards. Joe also represents clients in actions before federal and state agencies, such as the National Labor Relations Board and the Ohio State Employment Relations Board. His work on behalf of firm clients before these agencies have resulted in the dismissal of unfair labor practices against unions, the issuance of unfair labor practice charges against employers, an order confirming a union’s work jurisdiction, among other favorable results. In addition, Joe has successfully represented clients in a variety of arbitration proceedings, including contract disputes, withdrawal liability proceedings, and in disciplinary hearings.
Joe also assists with the firm’s compliance practice. Joe regularly attends trust fund board of trustees’ meetings, prepares plan amendments, counsels trustees on compliance matters involving new and existing laws and regulations, drafts summary plan descriptions and plan restatements, and represents trust funds and trustees in Department of Labor audits/investigations. In addition, Joe assists trustees in the development of policies and procedures to improve the operational efficiency of their trust funds. He has given presentations on employee benefit issues such as trustee fiduciary duties, the Patient Protection and Affordable Care Act of 2010, developing collection and delinquency control procedures, among others.
Joe received his BA in philosophy/pre-law from St. Bonaventure University in 2004, where he was a member of the Phi Eta Sigma National Honor Society and the Mock Trial Team. Joe earned his JD from Cleveland-Marshall College of Law in 2007, where he received LexisNexis and CALI Awards for his work in the Employment Law Clinic and in Legal Ethics. He is licensed to practice in all Ohio state courts, as well as the U.S. Sixth Circuit Court of Appeals, the U.S. Federal District Courts for the Northern and Southern Districts of Ohio, and the United States Bankruptcy Court for the Northern District of Ohio. Joe is a member of the AFL-CIO Lawyers Coordinating Committee. Joe was included in the 2012, 2013, 2015, 2016 and 2017 Ohio Super Lawyers Rising Stars list.
Joe was born and raised in Erie, Pennsylvania and now resides in University Heights, Ohio. Joe’s mother and his father are retired public school teachers. His grandfather was a Teamster with Local 397, who drove for Lyons Transportation in Erie, Pennsylvania. Joe is an avid downhill skier. He also enjoys cycling, fishing, and sometimes golf.
